Under [Articles 74–148 of the Family Code](https://lawphil.net/executive/execord/eo1987/eo_209_1987.html), the starting hierarchy is a valid marriage settlement executed before the wedding, the applicable Family Code regime, and then local custom. Without a valid settlement selecting another regime, absolute community generally governs marriages celebrated under the Family Code.

## Which property regime applies?

### Absolute community of property

Absolute community generally places property owned at the time of marriage and acquired afterward into one community, subject to statutory and agreed exclusions. Property acquired during marriage is presumed community property unless an exclusion is proved. ### Conjugal partnership of gains

Under a conjugal partnership, each spouse generally retains ownership of exclusive property while the partnership receives the proceeds, products, fruits and income described by law and property acquired through the spouses’ efforts or by chance. The net gains are divided upon dissolution, subject to the governing settlement and Family Code rules.

### Complete separation of property

Spouses may select total or partial separation in a valid marriage settlement. Each spouse ordinarily owns, possesses, administers and disposes of their separate estate, while both remain responsible for family expenses in the proportions and manner required by law.

### Unions without a valid marriage

Articles 147 and 148 use co-ownership rules rather than automatically treating the relationship as an absolute community or conjugal partnership. Capacity to marry, exclusivity, actual contribution and good or bad faith can materially change the result.

## How to classify an asset

- **Identify the governing regime.** Review the marriage date, marriage certificate and any registered marriage settlement.

- **Trace acquisition.** Record when the asset was acquired and whether it came from earnings, inheritance, donation, exchange, redemption or exclusive funds.

- **Check exclusions and presumptions.** Do not assume that registration in one spouse’s name conclusively resolves ownership.

- **Trace payments and improvements.** Preserve bank records, loan statements, receipts and proof of any community or exclusive funds used.

- **Check consent and authority.** Determine whether both spouses signed or whether court authority was obtained where required.

## Who may administer, sell or mortgage property?

Administration and enjoyment of absolute-community property belong to both spouses jointly. When one spouse is incapacitated or unable to participate, the other may assume administration, but that does not automatically include authority to sell, mortgage or otherwise encumber common property. Article 96 requires court authority or the other spouse’s written consent for those acts; without it, the disposition or encumbrance may be void.

Different rules apply to genuinely exclusive property. Under the conjugal-partnership provisions, an adult spouse may generally dispose of their own exclusive property without the other spouse’s consent. Classification therefore has to be resolved before deciding whether consent was necessary.

## Which debts can affect common property?

A debt signed by one spouse is not automatically either purely personal or fully chargeable to the community. The Family Code examines who incurred it, whether the other spouse consented, and the extent to which the family or common property benefited. Taxes, preservation costs, family support and specified obligations may be chargeable to the common fund, while gambling losses are borne by the losing spouse.

## Separation in fact does not automatically divide property

Living apart ordinarily does not by itself terminate the absolute community or conjugal partnership. The regime can end through death, legal separation, annulment or declaration of nullity, or judicial separation of property in the situations recognized by law. - bank, investment and loan statements;

- proof of inheritance, donation or exclusive source of funds;

- receipts for purchase, construction, repairs and improvements;

- written spousal consent, special powers of attorney and court orders;

- documents showing how a debt benefited—or did not benefit—the family; and

- records of separation, abandonment or disputed transfers.
