How Long Does Adoption Take in the Philippines?
Direct answer: There is no reliable single duration for the entire adoption journey. Republic Act No. 11642 sets review periods after a complete petition reaches particular stages, but orientation, case studies, the child’s legal-availability process, matching, supervised trial custody and missing documents may occur before or suspend those periods.
Statutory decision-stage periods
- The RACCO generally has 15 working days from filing to review compliance, interview the parties and issue its recommendation, but the period is suspended when additional information or documents are required.
- The Deputy Director for Services generally reviews the RACCO recommendation within 15 working days.
- The Executive Director generally acts within 15 working days after receipt, subject to return for further documents or investigation.
- The law states that domestic adoption cases are to be decided within 60 calendar days from the Deputy Director’s receipt of the positive RACCO recommendation.
These periods do not mean every applicant receives an adoption order 60 days after first contacting an office.
Stages that can add months
- orientation, counseling and preparation;
- home study and child case study;
- locating biological parents or determining the child’s legal availability;
- the three-month reconsideration period following voluntary relinquishment;
- matching for an unrelated legally available child;
- supervised trial custody of up to six months when required;
- obtaining psychological reports, foreign clearances or corrected civil records;
- publication, objections or further investigation; and
- post-order civil-registry processing.
Which cases may move differently?
Step-parent, relative and adult cases may avoid matching when the statutory conditions are satisfied. Supervised trial custody may also be waived after social-work assessment in specified cases. This can remove stages, but it does not remove eligibility, consent, documentary, interview and best-interest requirements.
How to prevent avoidable delay
- Confirm the correct route and RACCO before collecting documents.
- Use current official forms and check PSA entries early.
- Disclose foreign residence and family-status issues at orientation.
- Track expiry dates for clearances and medical reports.
- Respond promptly and completely to written document requests.
Be cautious of anyone guaranteeing approval by a particular date. NACC must evaluate the evidence and the adoptee’s best interests, and a lawful decision cannot be purchased or promised.
